In line with the requirements of the General Data Protection Regulation (“GDPR”) as implemented in the EU Regulation 2016/679 (in the Netherlands also known as Algemene verordening gegevensbescherming (“AVG”), Connected Capital must ensure compliance with GDPR with respect to the collection and processing of personal data.

This Privacy Policy Statement has been prepared by Connected Capital, a private company with limited liability established under the laws of the Netherlands, registered with the Chamber of Commerce under number 82211906. Connected Capital has its registered office at Apollolaan 151, 1077 AR Amsterdam.

This privacy policy (“privacy policy”) concerns the protection and processing of personal data of (employees or management of) portfolio companies, limited partners, prospects or website visitors in the context of their relationship with Connected Capital.

Where we use the terms “we“, “us” and “our” in this privacy policy, we are referring to Connected Capital.
This privacy policy applies where we are acting as a data controller with respect to your information, i.e. wherever we determine the purpose and means of the processing of that information.

The aim of this privacy policy is to provide information with respect to Connected Capital’s data processing activities relating to your personal data, particularly the basis on which your information is collected, stored and used by us. Furthermore, this privacy policy has been created to provide information on the rights under GDPR pertaining to how we process personal data.

1. What we collect

We collect, use, share and store personal and financial information about you. Most of the information collected by us is information which you have provided to us directly. For example, you may have signed up online to receive information from us or provided information to us when becoming an employee, limited partner or portfolio company.

Information we collect from you when you visit and/or request to receive information from this website (www.connectedcapital.nl) (“Website“):

  • personal contact information (e.g. name, email address); and
  • information collected via the use of cookies (e.g. your IP address, browser type, the pages you visit, the time and duration of your visit).
Limited partners

When you enter into a contract with us as our limited partner, you may provide us with the following information in order for us to perform our obligations under said contract, or to provide advice or guidance in relation to our products or services, or to fulfill our legal obligations:

  • personal contact information (e.g. name, [email] address, location);
  • proof of identification information, which may include a copy of your driver’s license, passport, or other appropriate identification documentation;
  • financial information (such as banking information and an account number); regulatory requirements, such as FATCA/CRS, TIN-number, KYC-required documents;
  • any other relevant information provided by you to us in correspondence; and
  • investment details.
Portfolio companies

When you enter into a contract with us as our portfolio company, you may provide us with the following information in order for us to perform our obligations under that contract or to provide advice or guidance in relation to our products or services, or to fulfill our legal obligations:

  • personal contact information (e.g. name, address, copy passport location);
  • financial information (such as banking information and an account number;
  • KYC-required documents; and
  • any other relevant information provided by you to us in correspondence.

For our legitimate business interest, we may also process a report of HR due diligence of management of the portfolio company.

Employment

As part of our hiring process, we collect and process personal data relating to job applicants in order to (i) ensure we meet our contractual obligations when entering into a potential contract with you, (ii) meet our legal obligations or (iii) properly manage the recruitment process. The following information is collected from you and is stored in certain systems and formats, e.g., in the recruitment file, in the organizations HR management system and in other IT systems, including the organizations email system:

  • name, address and contact details, including email address and telephone number;
  • gender and date of birth;
  • details of qualifications, including skills, experience and employment history, including start and end dates with previous employers;
  • details of your marital status;
  • nationality and entitlement to work in the Netherlands;
  • candidate photographs.

Furthermore, there may be some instances where we collect information about you when we believe our service will interest you. This includes personal contact information (e.g. name, (email) address, location, telephone number) from public databases.

2. How we use it

Once we have collected this information, we use it in a way that complies with all applicable laws. The purpose for processing personal data may include the following:

  • Contract performance – the information needed to perform our service;
  • Legal obligation – we are required by law to process or use your information;
  • Legitimate interest – we are allowed to use your information where, on balance, the benefits of us doing so are legitimate and not outweighed by your interests or legal rights; and
  • Consent – in some cases we may obtain your consent to use your information (when we use this reason, you always have the right to withdraw your consent).

As a limited partner or portfolio company, we will use your personal data in the following ways and for the following purposes:

  • to perform our obligations under our contract with you;
  • to provide you with advice or guidance in relation to our products or services that are offered by us;
  • to investigate any complaint, dispute and/or any concerns relating to your investments;
  • to comply with our legal obligations, such as identification verification, money laundering and
    other checks; and
  • to manage our business and administration.

If you choose to provide us with your e-mail address or other (indirect) personally identifiable information, we will use it:

  • to respond to your inquiry;
  • to support and enhance our service offerings to you;
  • in the preparation and performance of analysis and development; and
  • to comply with legal and/or regulatory requirements.

We store your personal data for as long as is necessary for the above-mentioned purposes or for secondary purposes in line with those purposes.

3. Sharing of your personal data

We do not sell your personal information to third parties for marketing purposes. We work with third parties to perform services on our behalf with respect to the processing of your personal data, such as third party relationships and service providers (including cloud providers). These service providers help us provide and improve information and/or services to you. Connected Capital only provides the amount of personal information that is necessary for these third parties to complete the requested service. Your personal data is provided subject to agreements which state that the service providers must keep such information confidential, that the data is not to be used for their own purposes, and that all information will only be used in accordance with applicable privacy legislation, including strict provisions in light of data security.

Connected Capital may transfer your personal data to a third country outside the EEA. If such a country does not provide an adequate level of protection for personal data, Connected Capital will ensure that appropriate and suitable safeguards are in place (e.g. ensuring that third parties residing in such countries adhere to the Privacy Shield).

Connected Capital adheres to a strict confidentiality standard when it comes to your personal information. Without your consent, Connected Capital does not share, sell, rent, lend or disclose any of the personal data you provide to us with any third party (e.g. for direct marketing purposes), except as described in this privacy policy. There may be exceptions because:

  • We must do so by law because we are under a duty to disclose or share your personal data in order to comply with any legal obligation; or
  • Some of our businesses may be restructured, bought or sold. In this event, your personal data may need to be transferred in order for the (new) entity(ies) involved in the restructuring to be able to continue to provide ongoing service to the affected customers.

Connected Capital uses cookies and similar technologies whenever you interact with this Website. This privacy policy may be updated over time to comply with applicable laws and regulations, or to meet our changing business requirements. This privacy policy includes the most recent version, which was last updated on 10 May 2022.

We aim to keep information about you as accurate as possible. You have a right to know if your data is being processed and, where that is the case, accessed. Under certain circumstances, you will have the right to rectify, erase, or restrict the processing of your personal data, and – where applicable – the right to withdraw your consent or the right to data portability.
